3. How and Why We Use Your Data (Purpose and Legal Basis)
• To provide the service: The legal basis is the performance of a contract. We process your image with AI and use your email to return it to you. This is the main purpose of our service. • For marketing and portfolio purposes: To showcase the quality of our work, we may select certain images (both original and processed) to display on our website and in our marketing materials. The legal basis for this is the performance of our contract with you (our Terms of Service), which includes the license you grant us for this purpose. We will always strive to use these images anonymously, without linking them to your personal identity. • To improve our service: Subject to your explicit and optional consent, we may use your images to train our AI algorithms. You can refuse consent without any impact on the service. • For security: The legal basis is our legitimate interest in protecting our platform from abuse or cyber-attacks.
4. Data Retention
Your privacy is a priority. Images you upload that are not selected for our portfolio are permanently deleted from our servers within 72 hours of delivery. However, if your image is selected to be showcased in our portfolio, as described in our Terms of Service, it will be retained for as long as it is used for these promotional purposes. Your email address is kept only for the time necessary to complete your request.
5. Sharing with Third Parties
• AI Technology Partners: To modify your images, we may use third-party AI technology providers. Your images are shared with them for the sole purpose of performing the requested processing. • Public Display: If your image is selected for our portfolio, it will be made publicly available on our website and in our marketing materials. • Other Providers: We use providers for technical services like hosting. These partners are bound by strict confidentiality agreements. • We never sell your data or your images.
6. User Rights
You have the right to access, rectify, or request the erasure of your data. As images are deleted quickly, we encourage you to exercise your rights promptly by contacting us at the provided email. You also have the right to lodge a complaint with a supervisory authority.
7. International Data Transfers
Our AI processing technology partners may be located outside the European Union. In such cases, the data transfer is protected by adequate safeguards, such as the Standard Contractual Clauses (SCC) approved by the European Commission.
